Welcome to The Koi Store. These Terms of Service (“Terms”) govern your use of our website and the purchase of our hand-selected Japanese koi carp.

By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our services.

These Terms comply with applicable UK legislation, including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

2. Use of Our Website

By using this site, you confirm that:

  • You are legally capable of entering into binding contracts

  • You will not misuse this website or engage in unlawful activity

We reserve the right to restrict or terminate access if these terms are breached.

3. Our Products (Live Koi Carp)

All koi carp sold are:

  • Individually selected, live ornamental fish

  • Unique in colour, pattern, and development

Please note:

  • Images and descriptions are representative but not guaranteed to remain identical over time

  • Natural variation and development are expected

4. Orders & Contract Formation

  • Orders are subject to acceptance and availability

  • After placing an order, you will receive an acknowledgement email

  • A legally binding contract is formed only when we confirm dispatch

We reserve the right to:

  • Refuse or cancel orders

  • Correct pricing or listing errors

5. Pricing & Payment

  • All prices are listed in GBP (£)

  • VAT is included where applicable

  • Payment must be made in full before dispatch

We use secure payment providers. We do not store your payment details.

6. Delivery

Delivery is subject to our Shipping Policy.

Key conditions:

  • Delivery dates are agreed in advance

  • You must be available to receive the delivery

  • Risk transfers upon successful delivery

All koi are shipped using specialist livestock couriers.

7. Live Arrival Guarantee

We guarantee that all koi will arrive alive and in good condition, provided that:

  • Delivery is accepted on the agreed date

  • The shipment is opened promptly

Any issues must be reported immediately in accordance with our Returns & Refunds Policy.

8. Returns, Refunds & Cancellations

Due to the perishable nature of live fish:

  • Returns are not accepted once delivery is completed

  • The 14-day cancellation right under the Consumer Contracts Regulations 2013 does not apply after dispatch

  • Orders may be cancelled prior to dispatch

Your rights under the Consumer Rights Act 2015 remain unaffected.

9. Customer Responsibilities

You agree to:

  • Provide accurate delivery information

  • Be present to receive delivery

  • Acclimate fish correctly upon arrival

  • Maintain suitable pond or tank conditions

We are not responsible for issues arising from improper care after delivery.

10. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for losses occurring after delivery

  • We are not responsible for indirect or consequential losses

Nothing in these Terms excludes or limits your legal rights under the Consumer Rights Act 2015.

11. Events Outside Our Control

We are not liable for delays or failure to perform obligations due to events beyond our control, including:

  • Severe weather

  • Courier disruption

  • Natural events

We will always act reasonably to minimise disruption.

12. Intellectual Property

All content on this website—including images, branding, and descriptions—is owned by The Koi Store.

You may not reproduce, distribute, or use any content without written permission.

13. Privacy

Your personal data is processed in accordance with our Privacy Policy and UK data protection laws.

14. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes will be subject to the jurisdiction of the courts of England and Wales.
